sorry girls
i have a buyer who wasn't paying so i set up an unpaid claims case - they no longer want the one item...but will purchase the other is there a way to do this without being charged my selling fees?

if you choose to "close the dispute" and then click the appropriate box for "seller and buyer have agreed to cancel transaction" you will be refunded your seller fees and can relist the item and let the buyer buy it again. but i dont think you should even deal with them now if they messed you around so much already....they dont sound like a very good buyer! i have been having loads of ebay/paypal problems lately, i dont think i will bother with ebay anymore

i tried this - it wont let me click that option...
you konw what they purchased 2 items and they only want the one - maybe i shouldn't allow them to purchase either one what do you think?
is that mean?
maybe i'm too nice...

no it is not mean, and yes you are too nice!!! they bought the 2, that is a contract and they should have to pay for the 2 or file a dispute,get your refund for sellers fees and have an "unpaid item" strike against their account. and then block them from bidding on any of your items ever again. if they being unreasonable already by not seeing through the sale, you can be sure they will either say they dont receive the goods, or leave unfair negative feedback.

i have sold a lot on ebay, they must pay for both the items, if not tell them you will file an unpaid dispute against them! i totally agree with nessamcv

I think you have a couple options...
Firstly, bidding and winning on eBay is a legally binding contract. If you wanted to, legally you could take this person to small claims court for the money and you would win. People don't do that usually unless it's a large amount of money, but you could.
See if you can work out a deal that you sell them the one item they want and see if they will throw in the cost of your seller fees too. I'm assuming your seller fees are probably only a dollar or two right? If they do that, then you will have successfully closed the case.
Or you can tell them too bad, it's a binding contract and if they don't pay the full amount, you will file unpaid item claims with eBay and leave negative feedback. If they have an established account, they probably won't want this.
Personally, I'd try to see if they'd throw in extra money for your seller fees. You are less likely to get anywhere with the second option because if they are trying to back out now, chances are they aren't an avid eBayer.
